Landlord Portal Terms of Use for Landlords

  1. Introduction

    1. Welcome to the terms of use for the Landlord and Tenant Address Portal (the “Landlord Portal”). They affect your legal rights, so please read them carefully. The Landlord Portal provides a system for you to record information about Tenants in rental properties for the purposes as set out in our Privacy Policy.
    2. As a Landlord or an employee or agent of a Landlord, your use of the Landlord Portal is governed solely by these terms of use (the “Terms of Use”), which is an agreement made between you (“you”, “your”) and Landlord Tap Ltd of 36 Broadway, London SW1H 0BH (“we”, “us”, “our”). These Terms of Use include our Privacy Policy.
    3. In these Terms of Use, the following words have the following meanings:
      1. “GDPR” means the General Data Protection Regulation EU 2016/679
      2. “Landlord” means an individual or entity that leases property to another. This includes private landlords, managing agents, councils and housing associations;
      3. “Personnel” means your employees, consultants, agents, representatives and contractors, where relevant;
      4. “Tenant” means the person or persons who are responsible for the payment of water and/or sewerage charges at properties you own or are responsible for; and
      5. “Water Company” means any authorised provider or providers of water and/or sewerage services permitted to use the Landlord Portal.
    4. We may amend these Terms of Use from time to time. We will notify you of any such changes. If you continue to use the Landlord Portal after any such changes have been made, this will constitute your acceptance of the amendments.
  2. Your obligations

    1. In order to comply with data protection law, you must:
      1. give Tenants sufficient notice that their personal data will be provided to and used by us and by Water Companies as explained in our Privacy Policy.
        That notice must comply with the requirements of the GDPR, UK data protection legislation and these Terms of Use. ; and
      2. make sure that you keep evidence to satisfy us that you have notified Tenants in accordance with clause 2.1.1. This could be in the form of a written record confirming the notification. You must provide this evidence to us if we ask you for it.
    2. In addition you must, and you must ensure that your Personnel:
      1. use the Landlord Portal only in accordance with these Terms of Use;
      2. keep login details safe and secure and prevent any unauthorised access to the Landlord Portal;
      3. restrict access to the Landlord Portal to authorised Personnel only and ensure that, as soon as an employee’s period of employment ends, their access to the Landlord Portal is revoked;
      4. make sure that all required contact details you provide to us are up to date;
      5. comply with any restrictions or prohibitions which apply to your use of the Landlord Portal and which are notified to you; and
      6. notify us promptly and provide relevant information if you become aware of or suspect any breach of these Terms of Use or any fraud, virus or error affecting the Landlord Portal.
  3. Restrictions on use

    1. You must, and must ensure that your Personnel:
      1. only upload information which you know is correct and up-to-date;
      2. never transmit any viruses to the Landlord Portal or any material that is unlawful, harmful, infringing, facilitates illegal activity, and/or causes damage or injury to any person or property;
      3. never access all or any part of the Landlord Portal in order to build a product or service which competes with the Landlord Portal;
      4. never use the Landlord Portal to provide services to third parties; or
      5. never change, alter, extract, data mine, scrape or re-use any part of the Landlord Portal, or copy any part of the Landlord Portal or any other material provided by us for commercial purposes without our permission.
    2. Other than as specifically referred to in these Terms of Use, we do not give you or your Personnel any permission to use our intellectual property rights.
  4. Support and maintenance

    1. If you experience any problems, issues and/or faults with registration or access to the Landlord Portal, we are happy to provide telephone and email support (which will be available during specified times).
  5. Our liability

    1. We make no warranty or representation that your use of the Landlord Portal will be uninterrupted or error-free.
    2. We will not be liable for any delay in performing, or failure to perform, any of our obligations under these Terms of Use, which is caused directly or indirectly by any event, act, omission, or circumstances beyond our reasonable control.
    3. To the fullest extent permitted by law, we will not be liable to you in any circumstances whatsoever for any loss or damage that you suffer or incur as a result of your use of the Landlord Portal.
  6. Your liability

    1. You will indemnify us against all or any losses, liability, costs or expenses suffered or incurred by us directly or indirectly in connection with or arising as a result of your failure to provide sufficient notice to Tenants that we and Water Companies may access and use their personal data in accordance with these Terms of Use.
  7. Cancellation, suspension and termination

    1. You may cancel your registration with the Landlord Portal by contacting us at LTAPHelpdesk@candc-uk.com
    2. Your right to use the Landlord Portal will terminate automatically if:
      1. we believe (in our sole discretion) that you or your Personnel are misusing this Landlord Portal or otherwise not complying with these Terms of Use; or
      2. you cancel your registration.
    3. Upon termination or suspension of these Terms of Use:
      1. you shall no longer be entitled to use the Landlord Portal;
      2. Clauses 5, 6, 7, 8 and 9 shall continue in full force and effect; and
      3. we, and Water Companies, shall be entitled to retain data uploaded by you or on your behalf to the Landlord Portal in accordance with our data retention policies.
  8. Data Protection

    1. Each party acknowledges and agrees that:
      1. it is a data controller in respect of any personal data it processes pursuant to these Terms of Use; and
      2. it will comply with its obligations under all applicable data protection and privacy laws (including unless and until it is no longer directly applicable in the UK, the GDPR and any national implementing laws, regulations and secondary legislation, as amended or updated from time to time, in the UK, and any successor legislation to the GDPR or the Data Protection Act 1998).
  9. General Provisions

    1. Other than as expressly set out in these Terms of Use, a person who is not a party to them will have no right to enforce any of their terms. You may not transfer or assign any of your rights or obligations under these Terms of Use without our prior consent.
    2. You acknowledge and agree that we may use agents or subcontractors to help us provide the Landlord Portal.
    3. If any part of these Terms of Use is unenforceable, unlawful or void in any relevant jurisdiction then that part shall be separated from the rest of these Terms of Use which shall continue to be valid and enforceable.
    4. These Terms of Use constitute the entire agreement between us in respect of your use of the Landlord Portal. No warranty shall be implied or have any effect unless specifically included in any changes to these Terms of Use subsequently notified by us.
    5. These Terms of Use and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction.
